Kochi. The Kerala High Court has said that when serious crimes of rape under the IPC or Poxo Act are proved prima facie, the victim’s petition will also be ‘given no preference’. This decision of the High Court has come on the petition of the victim and her mother, in which he demanded the dismissal of the case filed against his dance teacher and his wife under various IPCs. It also includes a section related to rape and the protection of children from sexual offenses (Poxo) Act.
The victim has mentioned several incidents in her statement to the police, when the dance teacher had sex with her in 2015. She was a minor at that time. He promised to make her work in films and reality shows.
The victim told the police that she had sex with her by promising to marry her. When the dance teacher married someone else, the victim told his wife about his affair.
According to the statement given by the victim to the police, the woman told the victim that she too could marry the dance teacher. After this, the wife also assisted and promoted her in sexual relations between the dance teacher and the victim.
When the victim became an adult in 2020, she turned back from the allegations made in her statement before the magistrate and denied that the dance teacher had raped or molested her or assisted her by his wife.
