Raj HC flags rising cyber fraud, rejects bail of two accused

Jaipur: Expressing concern over the “insidious” and rapidly growing menace of digital and online banking frauds, the Rajasthan High Court Saturday issued directions to the Union and State govts, Reserve Bank of India, and senior police authorities to strengthen mechanisms for prevention, detection, and public awareness of cybercrimes. The court called for legislative action, technological safeguards, coordinated enforcement, and sustained public awareness campaigns, and flagged misuse and sale of personal data by intermediaries. “The process of registration of cyber fraud complaints should be simple, not complicated, so that the complaint can be lodged immediately and all efforts are made by all the stakeholders to save the money of such cyber fraud victims,” the court said. The directions were issued while rejecting the second bail applications of two accused, Vivek Yadav and Karan Yadav, allegedly involved in multiple cyber fraud cases. Justice Anoop Kumar Dhand, while dismissing the bail pleas, held that there was no material change in circumstances after completion of the investigation and filing of the charge sheet.In its concluding observations, the court underlined that “digital scams emerged as one of the most dangerous forms of modern cyber crime”, posing a serious threat to innocent citizens who often lose their life savings. The court clarified that the observations shall not influence the trial on merits.
