Mumbai: Versova police on Tuesday submitted documents to the Mumbai police commissioner office for cancellation of the weapon licence issued to actor Kamaal R Khan after he was arrested last Saturday by Oshiwara police in Andheri housing society firing case.Police said two bullets were found lodged in a cupboard and a wall inside the flats of screenwriter Neeraj Mishra and model Prateek Baid in Nalanda building on Jan 18, about 300m from Khan’s bungalow, and they were fired from his licensed 7.76mm Mauser. Versova police initiated the process as the weapon was issued by them after it was transferred from Delhi. On Tuesday, police produced Khan before the Andheri court seeking his custody extension on the grounds that they had to recover seven missing bullets out of the 30 which he declared, with two already fired. However, the court granted Khan judicial custody on completion of his police custody on Tuesday. Court kept his bail application hearing for Wednesday. Meanwhile, his lawyer applied for bail.Lawyer Sana Raees Khan, representing the actor, argued in court that ingredients of intention and knowledge to attract abetment to culpable homicide was not established towards the applicant. “Police sought further police custody on the ground that bullets from KRK’s arms are missing,” she argued. She said Indian Penal Code or Bharatiya Nyaya Sanhita doesn’t criminalise non-accounting of bullets. That is an administrative breach to be looked into by the licensing authority and not the criminal court. At the most, section 30 of Arms Act would be applicable, which is a minor offence and punishable with fine and 6 months imprisonment. He has been arrested without notice under section 35(3) in violation of Supreme Court guidelines. Hence, further custody is not required. “Khan said he will surrender the seven bullets (missing) once he gets bail as the bullets are with his brother who resides in UP,” said the officer.
