HC adjourns hearing on petition seeking FIR against Rahul Gandhi

Prayagraj: The Allahabad high court has adjourned till March 11, 2026, a petition seeking registration of a case against leader of opposition in Lok Sabha and Rae Bareli MP Rahul Gandhi for his statement that his fight is against RSS, BJP and the Indian state (‘Bharat rajya’).While fixing the next date for hearing, Justice Samit Gopal permitted the petitioner, Simran Gupta of the Hindu Shakti Dal, to file supplementary affidavit within two weeks stating the ground for registration of case against Gandhi.However, Justice Gopal made it clear that the court was not passing any interim order.The petition moved the high court to challenge a Sambhal court order that rejected an application seeking the registration of an FIR against Gandhi over the alleged controversial remarks.The petitioner contended that Gandhi’s remarks hurt public sentiments across the country. The controversy pertains to the statement allegedly made during the inauguration of the All-India Congress Committee (AICC) office in 2025, where Gandhi reportedly said, “We are now fighting the BJP, the RSS, and the Indian state itself.”Last year, a Sambhal court initially rejected the petition seeking registration of an FIR. A subsequent revision plea filed against the said order was also dismissed after which the applicant moved the high court.On Wednesday (Feb 11), the matter came up before a bench of Justice Samit Gopal, where additional govt advocate submitted that the petition had failed to disclose the grounds of challenge to the impugned (under challenged) orders.On this, the counsel for the petitioner sought two weeks’ time to file a supplementary affidavit disclosing the grounds of the challenge.Allowing the petition, the court directed that if any such supplementary affidavit is filed, the office will restore the same and place it on record by the next date of hearing on March 11.
