Court dismisses anticipatory bail plea of dacoity accused | Kanpur News

Kanpur: Additional district and sessions judge, Kanpur Nagar, Sapna Tripathi, on Wednesday dismissed the anticipatory bail plea of accused Anuj Kumar Nigam, who was charged by the police for thrashing, intimidation, dacoity, etc under sections 323/504/506/395/147/148/384/386/211/292/352/34/120 B IPC).The judge, in her order, observed that the prosecution alleged that as the accused was not co-operating in the investigation, the court issued a non-bailable warrant against him on October 31, 2025. The accused filed the anticipatory bail application on December 1,2025, and this clearly indicates that the non-bailable warrant was issued against him before his anticipatory bail application.Since the investigation was going on, and in view of the facts and circumstances without expressing any point on merit, there was not any ground to grant anticipatory bail to the accused.

Hence his bail application was dismissed.According to district govt counsel Dilip Awasthi and additional district govt counsel Pradeep Sahu, the case against the accused was registered by the Juhi police on a court’s order in a complaint filed by Pragya Trivedi.Pragya in her complaint claimed that she was a partner of 10 percent in Classic Continental, a firm owned by Om Jaiswal, a resident of Hanspuram, Kanpur. There was a dispute between Om Jaiswal and accused Anuj Nigam. Ajay was pressuring her to give Rs 2 lakh. When she refused, he threatened that he was an editor of a magazine and would publish material against her.The ADGC stated that Anuj later published an article in obscene language and sent a notice through his advocate friend Rajesh Kumar Gupta. The police registered NCR against the accused on the complaint of Pragya Trivedi.On December 6, 2010 when she was in Classic Continental, Ajay Nigam along with his four friends reached there and again demanded Rs two lakh and threatened that if she failed to fulfil his demand then he would write more in his magazine.When they came to know that an FIR had been registered against him, they abused Pragya and thrashed her and snatched her two gold chains from her neck. The complainant once again approached the police but no action was taken. Thereafter she moved a complaint against the accused and the court ordered to register a case and investigate the matter.The accused, on the other hand, in his anticipatory bail application pleaded that the matter was 14 years old and he had been fabricated.

On the date of the incident, he was not in the city. The contents in the FIR were absolutely false, therefore his anticipator bail application be allowed.The ADGC submitted in the court that the accused along with the co-accused made an illegal demand of Rs two lakh and published an obscene material in a magazine when she did not oblige them. They thrashed her and snatched her gold chains. As the nature of the crime was of serious nature hence anticipatory bail application should be dismissed.
