Chandigarh court accepts cancellation report in rape case against former JJP leader Godara

Chandigarh: The district court here on Wednesday accepted a cancellation report filed by Chandigarh Police in the 2021 rape case registered against former JJP functionary Ramesh Godara. The court stated in its order that the allegations against the accused could not be substantiated by the evidence available on record.The FIR was registered at Sector 3 police station on a complaint filed by a 33-year-old woman from Hisar. The woman alleged that Godara brought her to Chandigarh on the pretext of treatment and allegedly raped her at the MLA Hostel in Sector 3. The woman alleged that the accused took objectionable photos and videos of her, and took her to the houses of two other persons in the city.Police initially registered an FIR in Chandigarh based on a zero FIR registered in Hisar. The FIR was registered under sections 376(2)(n), 376(2)(f), and 506 (criminal intimidation) of IPC.While hearing the case, the chief judicial magistrate (CJM) said the complainant’s allegations were not supported by any concrete evidence. The court, referring to the report of MLA Hostel officials, statements of doctors from Kalka and Hisar, and other documents, said these did not support the allegations. The court also mentioned that the alleged chats between the complainant and the alleged person also failed to prove the allegations.In such circumstances, no prima facie case was made out on record, due to which the cancellation report was accepted.
