Prayagraj: The Allahabad High Court has directed that any person without a BEd degree will not be appointed against the post advertised for assistant teacher/ trained graduate teacher (art) examination-2024 organised by the Uttar Pradesh Public Service Commission (UPPSC).The court directed the respondents to proceed with the selection process. The UPPSC had made BEd degree as the preferred qualification for the aforesaid posts. The petitioners challenged the advertisement to the extent where the BEd degree was made preferential and not a minimum qualification for the post. Hearing the writ petition filed by the Vinod Kumar Yadav and four others, a division bench of Justice Saral Srivastava and Justice Sudhanshu Chauhan issued notice to the advocate general of Uttar Pradesh.
The court also directed the state govt, UPPSC and others to file their respective replies in the matter and fixed March 13, 2026, as the next date of hearing. The petitioner had challenged the advertisement issued by the UPPSC on the grounds that it provides BEd would only be a preferential qualification for selection. According to petitioners, the aforesaid clause is contrary to the National Council For Teacher Education (NCTE) notification dated Nov 12, 2014 by which BEd has been prescribed as an essential qualification for being appointed on the post of teachers. In addition to it, the petitioners’ counsel Seemant Singh placed reliance on the judgment of Supreme Court in APJ Abdul Kalam Technological University and another vs. Jai Bharat College of Management and Engineering Technology and others, (2021) 2 SCC 564 in contending that the qualification prescribed by NCTE is binding on the state govt and it cannot be diluted. The NCTE oversees teacher education in India, setting standards, regulations and guidelines to ensure quality across institutions.
It also explores, updates regulations and resources for educators. The court in its order dated Jan 16 relied upon the earlier order dated Sept 12, 2025 whereby the high court had directed that the respondents may proceed with selection process but any person not having BEd qualification will not be appointed against the post advertised for assistant teacher computer (male/female).
