Driver slapped with fines and licence points for ‘speeding’ on motorway at 47mph

A driver has been slapped with a fine after speeding on the motorway at 47mph when a temporary speed limit was in place.

A man from Gloucestershire has been fined for travelling at 47mph on the motorway between the M4 (Junctions 19 and 20) and the M5 (Junctions 15 to 17).


The offence saw the driver clocked on an automated speed camera travelling at 47mph while a speed restriction of 40mph was in place.

The 64-year-old’s case was heard at Bath Law Courts in November last year after speeding in his Renault in January.

The motorist was found guilty in his absence, according to the Swindon Advertiser, and was hit with a £220 fine and issued three penalty points on his licence.

He was also ordered to pay a surcharge of £88 and prosecution costs of £110.

The minimum penalty for speeding is a £100 fine and three points added to a driver’s licence.

This can lead to them being stripped of their licence if they build up 12 or more points within three years.

If caught by a speed camera, a driver will be sent a Notice of Intended Prosecution and a Section 172 notice, which must be returned to the police within 28 days, informing them of who was driving the car.

Once the Section 172 notice has been returned, the driver will either be sent a Fixed Penalty Notice (FPN) or a letter telling them to go to court.

In the event that a driver is given a Fixed Penalty Notice and they plead not guilty, they risk being fined more if they are found guilty.

This will depend on what the speed limit was and how much they exceeded it by, with heftier punishments if the offence was on the motorway.

The fine will usually be a percentage of their weekly income, which can be up to £1,000 or £2,500 if they were travelling on a motorway.

Young drivers could face further consequences for speeding, as their licence will be revoked if they build up six or more penalty points, if they passed their test within the last two years.

Temporary speed limits can be installed on motorways for several reasons, including road works, extreme weather or following a road traffic accident.

A temporary limit will feature the number in a red circle, which must be adhered to. Experts from Start Rescue state that an advisory limit is a “recommended speed” with flashing lights.
