10 years on, no occupancy certificate: Gurgaon’s Ansal Heights families seek action against realtor

Gurgaon: Over 300 families residing in Ansal Heights in Sector 92 have appealed to the department of town and country planning (DTCP), Haryana, seeking urgent intervention after alleging that the housing project has been occupied for nearly a decade without mandatory occupancy certificate (OC).According to a release issued by the residents on Sunday, the developer began offering fit-out possession in 2015, assuring buyers that the OC would be obtained within six months. However, nearly 10 years later, the certificate is yet to be secured, raising concerns about safety, legality of occupation and regulatory enforcement.An occupancy certificate is a statutory requirement confirming compliance with approved building plans, safety norms, and regulations. In the absence of the certificate, residents said they face legal vulnerability, possible penalties, and difficulties in obtaining individual electricity and water connections. They also flagged issues related to property registration, resale, home loans, and compliance with fire and structural safety standards.Residents claimed they were repeatedly given assurances over the years, but no clear timeline or transparent update on the OC application has been shared. They stated that despite paying the full purchase amount along with maintenance and statutory charges, they continue to live in uncertainty due to the developer’s failure to complete legal formalities.“This is not just a contractual dispute; it is a matter of public safety and governance. Hundreds of families cannot be left in legal limbo for years while authorities look the other way,” a resident said in the statement.The residents have demanded immediate public disclosure of the status of the certificate, a binding and time-bound commitment for obtaining it, and accountability for the prolonged delay and what they described as misleading assurances. They have urged DTCP and the Haryana real estate regulatory authority (RERA) to enforce compliance and ensure early resolution. The residents said they will pursue legal remedies if the issue remains unresolved. The developer could not be contacted for comment.
