Bhilwara: Drawing the House’s attention through a special mention motion, independent MLA from Bhilwara, Ashok Kothari, said in the state Assembly Wednesday that daughters misused property rights under Hindu Succession Act and amendments in the law were necessary to address this.Kothari said that sons and daughters had equal rights in parents’ property but in many cases daughters left home of their own will with a person from another society or community. In such cases, he said, families filed FIRs at police stations and, when the matter reached court, the daughters refused to even recognise their parents and gave a statement that they wished to live with the other person.
The MLA said that after the death of parents, daughters sell their share to persons outside the family, which increases disputes in families and leads to a rise in court cases.Kothari told the House that considering the increasing number of such cases in the state, necessary controls and clear provisions should be made in the inheritance process. He said that when a daughter gave a statement in court to sever ties with her parents, then a review of her rights in parental property was necessary.Kothari also expressed hope that after amendement of inheritance laws, incidents like love jihad and trapping of innocent girls for sake of property would also be curbed.
