Cuttack: In a major relief to govt engineers, the Orissa high court has quashed two controversial clarifications issued by the state’s ST & SC development department on promotions, ruling that they were “not sustainable in the eyes of law.

The clarifications held that the Reserve Category candidates are eligible to be promoted against the vacancies earmarked for unreserved candidates without any restriction.The verdict came from Justice Biraja Prasanna Satapathy, disposing of a batch of 64 writ petitions through a common order on Jan 22, which was uploaded on Thursday.The dispute arose after assistant engineers (civil), who were found eligible and recommended for promotion to the post of assistant executive engineer (civil) by a departmental promotion committee on Sept 4, 2024, saw their promotions cancelled by a notification dated March 4, 2025. The cancellation was based on govt clarifications issued on May 6, 2024, and Feb 27, 2025, which relied on a law department opinion dated Feb 27, 2024.Setting aside the impugned clarifications, Justice Satapathy ruled that “any action taken based on such clarifications issued on May 6, 2024, and Feb 27, 2025, are also not sustainable in the eye of law and stand quashed”.
