‘Probe biased’: Haryana Human Rights Commission says investigators shielded hotel owner in sewer cleaning deaths

Gurgaon: In connection with the death of two men during the cleaning of a hotel sewer line in Hansi in Oct last year, Haryana Human Rights Commission (HHRC) has sharply criticised the police investigation, terming it biased, suspicious and aimed at shielding the real culprits.The commission stated that the investigation records and documents placed before it indicated a “deliberate” and “well-planned” attempt to divert liability and protect those responsible.In its observations, the commission flagged the so-called appointment letter of the hotel’s assistant manager, noting that the document bore no date. It said this raised serious doubts and suggested that the letter was hurriedly prepared after the incident to shift responsibility away from the hotel owner, describing it as a blatant abuse of law and morality.The commission further questioned the legal opinion dated Nov 13, 2025, rendered by the deputy district attorney, which led to the dilution of charges from BNS Section 105 (culpable homicide not amounting to murder) to BNS Section 106 (death by negligence) without any recorded justification. This, the commission said, cast serious doubt on the investigation’s intent and conduct.“This is not merely a case of investigative negligence, but appears to be an institutional attempt to evade accountability,” said the commission, adding that half-hearted explanations and cosmetic investigations cannot be tolerated in such grave matters.Taking note of the seriousness of the case, the commission directed the superintendent of police, Hansi, to re-examine the case afresh and submit a detailed report at least one week before the next hearing. The SP was also asked to appear in person on the next hearing. In addition, the deputy superintendent of police who initially investigated the case and the deputy district attorney who rendered the legal opinion were summoned. The commission further expressed displeasure over the failure of the local civic body and the hotel management to submit their reports, warning that continued non-compliance with its directions will be viewed seriously.The full commission, comprising chairperson justice Lalit Batra and members Kuldip Jain and Deep Bhatia, further clarified that while compensation of Rs 30 lakhs each was paid to the families of the deceased, monetary relief alone does not amount to justice.
