Gurgaon: Homebuyers of a stalled project in the city have written to the economic offences wing (EOW) of Delhi Police alleging they are being contacted and urged to “withdraw” a criminal case. The FIR — registered on Aug 14, 2020 under sections 420, 406 and 120B of the IPC — pertains to allegations of cheating, criminal breach of trust and conspiracy in relation to CHD Vann housing project in Sector 71, developed by CHD Developers Ltd. According to an agreement inked that year, possession was to be offered within 42 months, by 2018.
Seeking intervention, the homebuyers have requested EOW to take cognizance of what they described as attempts to “influence the complainants”. They have also sought protection, apprehending further pressure if the matter is not addressed. In the written representation, dated Jan 12, submitted to the investigating officer at EOW, the allottees said over the past one to one-and-a-half months, they have received repeated calls from unknown as well as known mobile numbers. The callers, who allegedly claimed to be associated with a “CHD-Roots legal team”, requested the allottees to withdraw the FIR. Copies of the representation have also been marked to HRera Gurgaon and officials of the town and country planning department for information and necessary action, the complaint said.The buyers said they had executed builder-buyer agreements and made payments as per the agreed construction-linked plan. However, construction was allegedly stopped midway and no further communication was received from the developer, prompting the homebuyers to approach law enforcement authorities.The complaint notes that insolvency proceedings were initiated against CHD Developers Ltd before National Company Law Tribunal (NCLT). By an order dated Nov 21, 2025, NCLT allegedly segregated the CHD Vann project and placed it under the control of Roots Developers Ltd, the landowners of the project.The allottees said NCLT order doesn’t contain any direction requiring them to withdraw criminal complaints or FIRs, nor does it authorise any person to seek affidavits or consent from complainants for withdrawal of ongoing criminal proceedings. They said they had not signed any affidavit or document agreeing to withdraw the FIR.
